Article 1 — Purpose
These Terms of Service govern the rights, obligations, and responsibilities between MemeScribble (the "Service") and its users in connection with the use of the AI-powered meme generation service provided by MemeScribble.
Article 2 — Service Description
- AI-powered Wojak-style meme image generation using Google Gemini AI
- Public gallery display, sharing, and downloading of generated meme images
- Painter feature: draw directly on generated memes (paid tier or one-time free trial)
- Daily generation credits based on subscription plan (Free / Coffee / Steak)

Article 3 — AI-Generated Content & Copyright
Rights to AI-generated images created through MemeScribble are handled as follows:
- Generated meme images may be freely used by the user for personal, non-commercial purposes.
- Commercial use (sales, advertising, paid content, etc.) requires prior written consent from the Service operator.
- Copyright ownership of AI-generated content is currently disputed under applicable law; the Service does not warrant any copyright rights.
- The user bears full responsibility for copyright and portrait rights of any images uploaded to the Service.
- Portrait Rights & Likeness: The user assumes sole legal liability for any portrait rights (right of publicity / right of likeness) violations arising from uploading, generating, or distributing images that depict identifiable individuals. MemeScribble provides AI caricature-style transformation but does not verify consent from depicted persons. The user must obtain all necessary permissions before uploading photos of others.
Article 4 — Prohibited Conduct
Users must not engage in any of the following:
- Portrait Rights Violation: Uploading another person's face or photo to generate memes without their consent, or using generated caricatures for defamation, harassment, or commercial gain. All legal liability for portrait rights violations rests solely with the user.
- Defamation: Generating memes that defame real individuals or spread false information
- Adult Content: Creating obscene material, sexual deepfakes, or other adult content
- Hate Speech: Creating content that promotes hatred, discrimination, or violence against any group
- Misinformation: Creating deepfakes for election interference or political manipulation
- Service Abuse: Credit farming, automated bot generation, or attacking the Service
- Intellectual Property Infringement: Unauthorized reproduction or distribution of third-party copyrighted works
Violations may result in immediate account suspension and content removal without prior notice.
Article 5 — AI-Generated Content Disclosure
All images generated on MemeScribble are AI-generated content created using Google Gemini AI. In compliance with the EU AI Act (2025) and applicable AI regulations, all generated content is explicitly identified as AI-generated. When sharing such images with third parties, users are obligated to disclose that the content is AI-generated.
Article 6 — Disclaimer
- The Service provides no warranties regarding the accuracy or suitability of AI-generated content.
- The Service is not liable for any third-party rights violations arising from content generated or shared by users.
- The Service is not responsible for service interruptions caused by Gemini API outages, server maintenance, or force majeure events.
- Free tier users may not claim damages for service limitations such as credit exhaustion.
Article 7 — Copyright Infringement Reporting
If you discover content that infringes copyright under the DMCA (Digital Millennium Copyright Act) or applicable copyright law, please report it to the email address below. Reports will be reviewed within 72 hours of receipt.

Article 8 — Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the Seoul Central District Court.
Article 9 — Terms Modification
Any changes to these Terms will be announced via in-service notices or email in advance. If you do not agree to the modified Terms, you may discontinue use of the Service and delete your account.
Addendum — Third-Party Service Compliance
This Service uses the following third-party services. Users must also comply with the terms of service of each.
- Google Gemini API — Google AI Terms of Service
- Supabase — Supabase Terms of Service
- Cloudflare — Cloudflare Terms of Service
Section 10 — Right of Withdrawal & Refund Policy
Pursuant to the Electronic Commerce Act of Korea (전자상거래법) Article 17 & EU Consumer Rights Directive 2011/83/EU
1. General Cooling-Off Period
You have the right to withdraw from your subscription purchase within 14 days of the date of purchase without giving any reason, provided that the digital service has not been actively used.
2. Exception — Immediate Service Delivery
By completing your subscription purchase, you expressly acknowledge and consent to the immediate commencement of service delivery (meme generation credits become available instantly). The right of withdrawal is forfeited once you have consumed any generation credits, in accordance with Article 17(2)(5) of the Electronic Commerce Act and Article 16(m) of the EU Consumer Rights Directive.
A notice confirming your explicit consent to waive the withdrawal right upon first use of the service is provided at checkout.
3. Refund Conditions
- Full Refund: Requested within 14 days of purchase AND zero credits have been consumed.
- Partial Refund (Prorated): If a service malfunction attributable solely to MemeScribble prevented usage for a documented period, a prorated refund for the affected period may be issued at our discretion.
- No Refund: After any credits have been consumed, or after the 14-day withdrawal window has elapsed, or for promotional / discounted subscription plans explicitly marked as non-refundable.
4. How to Request a Refund
Send a refund request to support@memescribble.com with the following information:
- Account email address used at registration
- Date of purchase and subscription plan
- Reason for withdrawal (optional, but helpful)
We will process your request within 72 hours. Approved refunds are issued via the original payment method within 5–10 business days.
5. Governing Law
This refund and withdrawal policy is governed by the laws of the Republic of Korea. Disputes shall be subject to the exclusive jurisdiction of the Seoul Central District Court.
